PitchBud.io — Terms of Service

The site-specific terms that govern your use of PitchBud.io.

1. Scope and acceptance

These site-specific Terms apply to your use of PitchBud.io (the "Service", "we", "us") and incorporate the Archieboy Master Terms by reference. By creating an account or using the Service, you agree to both these site-specific Terms and the Master Terms. Where a conflict exists, these site-specific Terms control for PitchBud.io.

2. What we offer

PitchBud.io is an AI-assisted press release distribution and journalist outreach service. Specifically, we provide:

  • AI-drafted press releases generated from a one-line angle or a URL you supply.
  • A publicly hosted newsroom page for each release on the pitchbud.io domain, with Schema.org NewsArticle markup.
  • Automated submission of those URLs to free indexing channels (IndexNow, the WebSub hub, the Internet Archive), plus an experimental Google Indexing API ping where supported.
  • On paid plans, an AI scanner that finds journalists covering relevant beats, drafts personalised pitches, and provides a one-click send through your own email client.
  • On paid plans, parsing of source-request digests (HARO/Featured, Qwoted, SourceBottle, Help a B2B Writer) and AI-drafted expert responses against your profile.
  • Subscription billing through Stripe.

3. Acceptable Use Policy

3.1 Release truthfulness

You are solely responsible for the factual accuracy of every release you draft, publish, or distribute through the Service. AI-generated drafts are suggestions; you review, edit, and authorise publication. You may not publish a release that contains:

  • Statements of fact you know or should know to be false.
  • Quotes attributed to a person or company who did not authorise the quote, including fabricated AI-generated quotes.
  • Claims of endorsement, partnership, or affiliation that don't exist.
  • Deceptive financial, medical, or legal claims.
  • Stolen or unlicensed copyrighted material, including images.

3.2 Journalist outreach

The personalised-pitch feature is intended for legitimate, one-to-one outreach to journalists, podcasters, and newsletter writers who actively cover your beat. You agree to the following hard rules:

  • You will not use PitchBud to send unsolicited bulk email outside the intended one-pitch-per-journalist workflow.
  • You will not import a purchased, scraped, or rented contact list and pitch it through PitchBud.
  • You will respect a "do not contact" request from any journalist; we provide both a personal and a portfolio-wide DNC list and expect you to use them.
  • Pitches sent via PitchBud open in your own email client and are sent from your own inbox; you take full responsibility for what your client transmits under your name.

3.3 Editorial review

Every release runs through an automated editorial review before publication. The review may block publication if it detects: missing or invalid contact information, AI-fabricated marketing fluff, deceptive medical/financial/legal claims, adult or gambling content, hate or harassment, headlines unsupported by the body, or links structured as a link farm. A blocked release is not a refundable defect of the Service; it is the Service working as designed.

3.4 Prohibited content

You may not use the Service to publish or distribute: deceptive financial offers, unauthorised pharmaceutical promotions, fraudulent products, malware, phishing, sexually explicit content, hate speech, content targeting minors, unauthorised crypto pumps, or anything illegal in your jurisdiction. Content that violates the publishing or content policies of our upstream providers (Stripe, Anthropic, Google, AWS, GoDaddy, the Internet Archive, the IndexNow protocol) violates these Terms.

3.5 Compliance with anti-spam law

You are solely responsible for compliance with applicable anti-spam, privacy, and marketing laws in your jurisdiction and the jurisdictions of your recipients — including but not limited to CAN-SPAM (US), CASL (Canada), GDPR (EU/UK), and PECR (UK). Pitches sent through the Service are sent from your mailbox; the obligation to identify yourself, provide a valid postal address, and honour opt-out requests is yours.

4. Account suspension and termination

We may suspend or terminate your account, immediately and without prior notice, if:

  • You violate the Acceptable Use Policy in §3.
  • Your account is used for activity we reasonably believe is fraudulent (including stolen-card subscription payments).
  • You attempt to bypass plan limits, rate limits, or the editorial review — for example, by creating multiple accounts.
  • Our upstream providers (Stripe, Google, Anthropic, AWS) require us to.

If we terminate for cause under this section, no refund is owed for the unused portion of the current billing period. If you terminate your own account, you keep paid access through the end of the current billing period and then drop to the Free tier. Published release pages on the pitchbud.io domain may, at our discretion, be retained as part of the public newsroom or removed; we do not guarantee perpetual hosting after termination.

5. Subscription billing and refunds

Paid plans (Starter, Pro, Studio) are billed monthly or annually through Stripe. By subscribing, you authorise Stripe to charge the payment method you provide on a recurring basis until you cancel. Annual plans are billed once and are not pro-rated for early cancellation; monthly plans cancel at the end of the current period. Upgrades take effect immediately and are pro-rated; downgrades take effect at period end.

Refund policy:

  • We will refund the most recent billing period if you cancel within 7 days of your first payment on a paid plan and you have not published any releases in that window.
  • We will refund a billing period in good faith if you experienced a material service outage we caused that prevented you from publishing or sending pitches.
  • We do not refund payments made more than 30 days before the request.
  • We do not refund based on coverage outcomes — see §6.

6. No guarantee of coverage

PitchBud is a tool. It drafts releases, distributes URLs to free indexing channels, and helps you reach journalists. It does not guarantee that any journalist will respond, that any outlet will cover your release, that Google News will index your release page, that the Google Indexing API will accept your URL (the API is officially scoped to JobPosting and BroadcastEvent content), or that any specific reach, traffic, ranking, or revenue outcome will result from your use of the Service. Press coverage depends on the newsworthiness of your release and on editorial decisions outside our control.

7. Your content; AI-generated drafts

You own your releases and your contact lists. We do not claim any rights in either. We process your inputs only to generate the drafts, scans, and pitches you request, and only at the time you request them. We do not sell, share, or use your content to train any AI model, our own or anyone else's.

AI drafts produced by the Service are provided for your review and editing. Once you authorise publication or a pitch send, you take full responsibility for the content. We will not pre-approve or pre-vet AI drafts beyond the automated editorial review described in §3.3; the substantive human review step is on you.

You grant us a limited, non-exclusive, royalty-free license to store and process your releases, contact data, and pitches solely for the purpose of operating the Service and complying with our legal obligations. You additionally grant us a non-exclusive license to display releases you publish on the public pitchbud.io newsroom, to syndicate them to the destinations you select, and to retain them in the public archive after they go live.

8. Journalist data

Journalists, podcasters, and newsletter writers identified by the Service's scanner are not on a private list belonging to you; they are public-record contact information harvested at scan time from publicly accessible web pages. The scanner respects robots directives where present, and our Do-Not-Contact system honours both personal and portfolio-wide DNC entries. We may use aggregated, de-identified scan data to improve the Service.

9. Service availability and limitation of liability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, error-free operation, indexing by any specific search engine, deliverability of pitches to any specific recipient, or any particular open/click/conversion/coverage result. We use Anthropic, OpenRouter, Stripe, AWS, and several other upstream providers; outages or policy changes imposed by these providers are outside our control.

To the maximum extent permitted by law, our total liability arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, exemplary, or punitive damages, or for lost profits or lost business opportunity, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Archieboy Holdings, LLC and its officers, employees, contractors, and agents from any claim or demand arising from (a) your violation of these Terms, (b) your violation of any third-party right (including intellectual property, privacy, defamation, anti-spam, or securities laws), or (c) the content of any release you publish or any pitch you send through the Service.

11. Changes to these Terms

We may update these Terms when we add features, change policies, or respond to legal requirements. Material changes will be communicated by email to the address on file at least 14 days before they take effect, except where shorter notice is required by law or by an urgent security or compliance need. Your continued use of the Service after the effective date is acceptance of the updated Terms.

12. Governing law and contact

These Terms, and any dispute arising under them, are governed by and interpreted under the laws applicable to Archieboy Holdings, LLC as set out in the Master Terms. Notices and questions: contact us.

Plain-language summary: bring real news; respect journalists; we'll help you reach them and put a stable URL up. Lie, spam, or fabricate quotes and we will, automatically, block the release and likely your account.
